Welcome to PixGPT. These Terms of Service ("Terms") govern your use of the PixGPT AI Infographic Generator service at pixgpt.io (the "Service") operated by PixGPT ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 13 years old and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
PixGPT is an AI Infographic Generator that transforms text into professional infographics. The Service includes 21 layout options, 20 style options, and AI-powered generation capabilities. We may modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content.
3. User Accounts
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account by contacting support@pixgpt.io.
4. Subscriptions and Payments
Some features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscriptions are billed in advance on a recurring basis (monthly or annually) depending on your selected plan. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
Free Tier
We offer a free tier with limited usage. Usage under the free tier is subject to daily and monthly limits as described on our pricing page.
Price Changes
We may change our pricing at any time. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.
5. User Content
You retain ownership of the text you input into the AI Infographic Generator. By using the Service, you grant us a limited, non-exclusive license to process your input text for the purpose of generating infographics. You are responsible for ensuring that your input content does not violate any third-party rights or applicable laws.
Generated Content
Infographics generated by the AI Infographic Generator are owned by you. You may use, distribute, and modify generated infographics for personal or commercial purposes. We do not claim ownership of the generated output.
Content Restrictions
You agree not to input content that: is illegal, harmful, threatening, abusive, or defamatory; infringes any third-party intellectual property rights; contains malware or other harmful code; or violates any applicable law or regulation.
6. Intellectual Property
The Service and its original content (excluding user input and generated infographics), features, and functionality are owned by PixGPT and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.
7. Prohibited Conduct
You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to any portion of the Service; use automated systems (bots, scrapers) to access the Service; interfere with or disrupt the Service; reverse engineer any aspect of the Service; or use the Service to generate content that violates these Terms.
8. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the Service's reliability, accuracy, availability, or fitness for a particular purpose. We do not guarantee that the AI-generated infographics will be error-free or meet your specific requirements. You use the Service at your sole risk.
9. Limitation of Liability
To the fullest extent permitted by law, PixGPT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless PixGPT and its officers, directors, employees, and agents from any claims, actions, demands, liabilities, and settlements including legal fees arising from your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms or is harmful to other users or the Service. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall remain in effect.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
